Public Consultation on the draft Public Health (Tobacco and Other Products) Amendment (On‑Product Health Messages and Other Measures) Regulations 2024
The Public Health (Tobacco and Other Products) Act 2023 (the Act) commenced on 1 April 2024. The objects of the Act are to: improve public health by discouraging smoking and the use of regulated tobacco items, and encouraging people to give up smoking and to stop using regulated tobacco items; give effect to certain obligations that Australia has as a party to the World Health Organization Framework Convention on Tobacco Control; address public health risks posed by vaping and e-cigarette products; and to combat the trade in illicit tobacco and e-cigarette products.
The Act provides for the implementation of dissuasive measures on tobacco products such as on‑product health messages through regulations. The Australian Government is now undertaking a public consultation regarding proposed Regulations prescribing on‑product health messages.
The consultation period is open from 30 October 2024 to 8 November 2024.

Please note that changes may be made to the final regulations following this consultation process; the contents of the exposure draft will not necessarily reflect the scope of the final regulations.

Submissions are invited in response to the wording of the proposed amendments and in response to the specific consultation questions.
Submissions must be received by the Department of Health and Aged Care by
11:59 PM AEDT on 8 November 2024.

Please note we may not accept:

- comments received after the consultation deadline (11.59PM AEDT on
8 November 2024).

All submissions and the names of persons or organisations that make a submission will be treated as public, and may be published on the department’s website, unless you request that your submission be kept confidential, or if we consider (for any reason) that it should not be made public.
