Your personal information is protected by law, including the Privacy Act 1988 and the Australian Privacy Principles (APPs).
Who is collecting your personal information?
Your personal information is being collected by the Department of Health, Disability and Ageing (the department/ we).
What information is being collected?
Through your participation in the consultation, we may collect a range of personal information, some of which could be sensitive information. By choosing to participate in the consultation, you are giving us your consent to collect, use and disclose this information.
Through your participation of the consultation, we may collect a range of your personal information (some of which could be sensitive information) including your:
- name and email address
- organisation name (if applicable)
- job role (if applicable)
- approximate age
- gender
- location
- disability status
- carer status
- whether or not you identify as:
- First Nations
- Culturally and linguistically diverse
- LGBTQIA+
- your voice or image if you have provided an audio or video submission and
- your views on the program.
We may also collect personal information from you if you include the personal information in your responses to questions.
When you interact with our website, the Department also collects technical information including the IP address for the device you are using.
Why does the department collect your personal information?
We collect your personal information for the purpose of informing the design of the new Commonwealth individual disability advocacy program.
Your personal information may also be used for other purposes such as informing other projects or research purposes. In doing so, we will apply the Australian Privacy Principles to the handling of any personal information.
What would happen if the department did not collect your personal information?
If you do not or are unable to provide your personal information the department will not be unable to use it to inform the development of the new program.
Who will the department disclose your personal information to?
We may disclose your personal information to an external consultation who will be engaged by the department to develop a report on the results of the consultation. The external consultant will be subject to the Australian Privacy Principles, as required by section 95B of the Privacy Act 1988 (Cth). The external consultant may input your personal information into artificial intelligence (AI) tools for the purpose of analysing submissions received as part of this consultation. The department encourages any use of AI to be responsible and ethical and in alignment with Policy for the Responsible Use of AI in Government
Access to and correction of your personal information
The department’s privacy policy contains information about how you may access and seek correction of your personal information.
Privacy complaints
The department’s privacy policy contains information about how you may complain about a breach of the Australian Privacy Principles or the Australian Government Agencies Privacy Code and how the department will deal with complaints.
Overseas disclosure of your personal information
We may publish your personal information to overseas recipients if you provide consent. Please refer to Annexure A.

Consent
By providing your sensitive information to us, you consent to the Department of Health, Disability and Ageing collecting a range of your personal information about you for the purposes indicated above.
If you are providing the department with personal information about another individual, unless you are authorised to consent on their behalf, you will need to inform that individual of the contents of this notice, and obtain their consent to the department collecting their personal information.

Annexure A
The department is seeking your consent to publish your personal information on the department’s website. When it is published your personal information could be accessed by any person, including a person located overseas. The purpose of publishing the personal information is to inform stakeholders of the results and opinions gathered as part of the public consultation on the new Commonwealth Individual Disability Advocacy Program. This would be published as part of a consultation report. Ordinarily, where the department discloses personal information to an overseas recipient, Australian Privacy Principle (APP) 8.1 requires the department to take reasonable steps to ensure that overseas recipients do not breach the APPs. However, if you provide consent to the publication of your personal information, APP 8.1 will not apply to this disclosure and the department will not be accountable under the Privacy Act for any breach of the APPs by the overseas recipient, and you will not be able to seek redress under the Privacy Act.
I consent to my personal information being published on the department’s website and:
- understand that Australian Privacy Principle (APP) 8.1 requires the department to take reasonable steps to ensure that any overseas recipients to whom personal information is disclosed do not breach the APPs in relation to my personal information.
- acknowledge that I have been expressly informed that if I consent to the publication of my personal information APP 8.1 will not apply to the publication and after being advised of this, I consent to the publication.
- understand that the department will not be accountable under the Privacy Act 1988 (Cth) for any breach of the Australian Privacy Principles by an overseas recipient and I will not be able to seek redress under that Act.
- I understand that copyright in the content of my submission will vest in the Commonwealth of Australia;
- I understand that, where I have provided consent to my submission being published, the department has complete discretion as to whether my submission, in full or part, will be published.
I confirm I have obtained the consent of any other individuals whose personal information I have provided (including information about sole trader organisations) to:
- the department’s collection, use and disclosure of their personal information for the purposes outlined in the privacy notice;
- the department’s [publication/ overseas disclosure] of their personal information and acknowledge that after bringing the following matters to their attention, that the relevant individuals have provided their consent:
- the relevant individual understands that APP 8.1 ordinarily requires the department to take reasonable steps to ensure that any overseas recipients to whom personal information is disclosed do not breach the APPs in relation to their personal information
- acknowledge the relevant individual has been expressly informed that if they consent to the publication of their personal information that APP 8.1 will not apply and they have provided consent to the publication
- the relevant individual understands that the department will not be accountable under the Privacy Act 1988 (Cth) for any breach of the Australian Privacy Principles by an overseas recipient and they will not be able to seek redress under that Act
